What are the rules concerning delayed flights?
The European Parliament and European Court of Justice regulated flight cancellations, re-routings and denied boardings in 2004, in Regulation (EC) no. 261/2004. However, this Regulation didn't include flight delays, which are just as great a nuisance to passengers as cancellations are. The ‘Sturgeon arrest’ of 2009 put an end to this inequity: it stated that long delays are equal to cancellations. Thanks to the Sturgeon arrest, airlines should also pay delayed passengers compensation.
Airlines aren’t exactly delighted with the ‘Sturgeon arrest’. They'd rather not pay you any compensation whatsoever. Every year, 500 million air passengers encounter delayed flights and cancelled flights. About 30 million of them are entitled to compensation.
The Civil Aviation Authority has stated that airlines must continue to comply with the regulation after Brexit, so your rights are still covered for the foreseeable future when flying to and from the United Kingdom. The Regulation EC 261/2004 has been written into UK law, meaning that even after Brexit the passenger rights remain te same. The new law is called 'The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019'.
How much compensation should you receive for your delayed flight?
- For all flights of 1,500 kilometres or less, £220
- For all intra-Community flights of more than 1,500 kilometres and for all other flights between 1,500 and 3,500 kilometres, £350
- For all other flights (routes covering a distance greater than 3,500 kilometres) you'll be entitled to receive £520*
*The total amount can be reduced by 50% if your flight was delayed for more than three hours but less than four.
