Delayed or cancelled flights to or from Malaga or Spain fall under Regulation (EC) No. 261/2004. If you're flying to or from the UK, the airline that is operating your flight is also not relevant. So what does it mean if your flight falls under this Regulation?
It means that you could be entitled to receive compensation of up to 500 pounds per passenger. The conditions:
-Your flight was delayed or cancelled, or you were denied boarding,
-Your delay in arrival was 3 hours or more compared to your scheduled arrival.
-Your delay wasn't due to a strike, adverse weather, a bird strike, or a technical error that occurred mid-flight (after the aircraft went 'off blocks').
But if you are denied compensation from the operating airline, don't just believe them: don't allow yourself to simply be fobbed off as so many thousands have been in the past! Some airlines will try almost anything to evade their financial liability. Flight-Delayed can help you in your battle against the airline. The compensation amount can range from 250 euros (±200 GBP) up to 600 euros (± 500 GBP) per passenger, and this amount is completely irrespective of the price of your flight ticket. As long as you paid a full-price ticket, you fall under Regulation. That's why infants, for instance, often can't claim compensation, because parents usually travel with their infant on their lap, or pay a reduced tariff for their young children.
Non-UK flights to Malaga or non-UK flight to Spain's other destination: if you flew to Malaga from a non-EU country, you would only be entitled to receive compensation if your flight was operated by an EU carrier. If you flew from Malaga to another country, your flight will fall under Regulation regardless of where you travelled to or which carrier you travelled with. The claim calculator will help you determine this, and will give you free, non-committal advice.
