How to claim compensation for an Air Europa flight delay or cancellation

Air Europa is one of the best-known airlines in Spain. Despite its best efforts, every year thousands of passengers suffer problems at the airport. Especially flight delays and cancellations. Fortunately, Air Europa flights that have been delayed or cancelled give passengers the right to claim compensation for the problems experienced. According to European law, affected passengers are entitled to compensation of up to €600 if the flight has been delayed by three hours or more or if it was cancelled without notice and they have arrived at their final destination two hours or more late due to the cancellation.

Legal basis for claiming compensation for a delayed or cancelled Air Europa flight

If you have experienced a cancellation, delay or denied boarding incident during an Air Europa flight, you can relax as EC Regulation 261/2004 covers your flight and protects your rights. This document sets out the parameters by which it is determined whether, as an affected passenger, you are entitled to compensation from Air Europa. These conditions apply to all Air Europa flights, since it is a European airline, if your departure or arrival airport is within a member country of the European Union.

Reasons Air Europa may use to avoid paying compensation for cancelled or delayed flights

Air Europa (and other airlines) often justify delays and cancellations simply by arguing the occurrence of "extraordinary circumstances" in order not to pay the compensation to which its passengers are entitled in the event of a delayed, cancelled or overbooked flight. Although it is true that Regulation EC 261/2004 states that an airline will not have to pay compensation if an extraordinary circumstance has occurred, this excuse is often used very widely and without the necessary evidence.

It is quite difficult for passengers to determine whether or not an extraordinary circumstance has occurred and, as a result, their ability to assert their rights is also hindered. Therefore, Flight-Delayed has specialized in helping passengers receive the compensation to which they are entitled. We have all the necessary tools to verify the airlines' arguments and we are prepared to go to trial if necessary.
