Was your flight delayed by more than 3 hours due to the airline's fault? Then you can claim flight compensation!
Claim now with Flight-Delayed.co.uk! We will handle the whole claim process for you and even fight for your rights in court, if needed. We operate on a ‘no win, no fee’ basis so there is no risk for you!
It depends on the exact circumstances surrounding your AlbaStar cancellation. In some cases, you will be eligible only for compensation, in others only for a refund, and in some, you can claim both AlbaStar compensation and an AlbaStar refund!
If the cancellation of your flight was announced less than 14 days before the initial departure date, you might be able to claim flight compensation for it.
Keep in mind that in order for you to be eligible for compensation, AlbaStar must be the party at fault for the disruption. See the “Extraordinary Circumstances” section of this article to learn more.
You can claim an AlbaStar refund if your flight was cancelled and:
You were not offered an alternative flight
You were offered an alternative flight but decided not to take it
|Cancellation notice||Alternative flight||Compensation|
|Fewer than 7 days in advance||Departs 1h+ earlier or arrived 2h+ later||Yes|
|7-14 days in advance||Departs 2h+ earlier or arrived 4h+ later||Yes|
|Fewer than 14 days in advance||No alternative flight offered||Yes + refund|
The amount of the compensation depends on the distance of your flight:
|Distance of your flight||Compensation|
|Flights shorter than 1,500 km||Get £220 per passenger|
|Flight between 1,500 and 3,500 km||Get £350 per passenger|
|Flights of over 1,500 kilometres within the EU||Get £350 per passenger|
|Flights of over 3,500 kilometres outside of the EU||Get £520 per passenger|
Yes, you can! Even if you fly to a non-EU country, you are covered by the EU flight compensation rules, since AlbaStar’s headquarters are in Madrid, Spain.
For instance, if you were flying with AlbaStar to Egypt or Senegal, you can still claim compensation for a disrupted flight.
However, the situation might be different in the event that your flight was operated by a non-EU airline. Please check the table below to learn more.
|Type of flight||Example||Compensation|
|Flying with a British carrier||Tokyo to London with British Airways||Yes|
|Flying with a EU carrier||Amsterdam to London with KLM||Yes|
|Flying with a non-UK/non-EU carrier from the UK||London to Tokyo with Japan Airlines||Yes|
|Flying with a non-UK/non-EU carrier to the UK||Tokyo to London with Japan Airlines||No|
If the disruption was caused by a third party or force majeure — and therefore it is not the airline’s fault — AlbaStar is not obliged to pay compensation. These situations are called extraordinary circumstances.
Some of the most common extraordinary circumstances are:
Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).
However, a strike of the airline's crew is not considered an extraordinary circumstance!
Political circumstances, such as a terrorist attack or general security risk due to political unrest.
Natural disasters, including volcanic eruptions and hurricanes.
A collision between the aircraft and birds or other foreign objects.
An ill or unruly passenger.
Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.
Be aware though that airlines sometimes say that extraordinary circumstances occurred even if that was not the case. They do it in an attempt to avoid paying out the compensation to passengers.
The wait time to receive compensation or refund varies.
In many cases, passengers who claim flight compensation or refund with Flight-Delayed.co.uk, receive their money within a few weeks or months.
However, if the airline doesn't cooperate and/or the claim has to be taken to court, the wait time might get extended by a few additional months or even a few years.
Rest assured, though, that no matter how long the claim will take, our team will be there to keep you posted on any important updates and answer any of your questions.
